When dealing with an OR condition, if firstElement loads asynchronously, the logic may not work as expected.

By bypassing the Cypress retry mechanism using this approach, it's worth noting that Cypress does not document this method.
If you encounter asynchronous loading with firstElement, one workaround could be utilizing the fail event handler.
